These Terms and Conditions (“Terms”) govern your access to and use of the Meyer Painting website, including any forms, SMS/email communications, and requests for estimates or services submitted through the site. By using this website, you agree to these Terms.

2) Website Use and Acceptance

By accessing this website or submitting information through our contact forms, you agree to:

use the site for lawful purposes only, and

provide accurate information when requesting an estimate or contacting us.

We may update these Terms at any time by posting the updated version on this page.

3) Estimates and Scope of Work

Any estimate provided (written or verbal) is based on the information available at the time, including project conditions visible during a walkthrough or provided through photos/video.

Final scope, pricing, and timelines are only confirmed in writing (e.g., estimate, proposal, work order, or service agreement).

Unless explicitly stated in writing, estimates may exclude items such as extensive repairs, rot replacement, lead/asbestos mitigation, moving heavy furniture, specialty coatings, or structural work.

4) Scheduling and Access

Scheduled start dates and completion timelines are estimates and may change due to weather, material availability, jobsite conditions, or other factors outside our control.

You agree to provide safe and reasonable access to the work areas (including parking/access codes/gates as applicable) and to ensure utilities (water/electricity) are available if required for the work.

5) Customer Responsibilities

You agree to:

disclose known issues that may affect the work (water intrusion, peeling paint history, prior coating failures, etc.),

remove or secure valuables, fragile items, and wall hangings from work areas (unless otherwise agreed in writing),

keep children and pets away from work areas for safety.

If areas are not ready or accessible, additional charges or rescheduling may apply.

6) Deposits, Payments, and Fees

Deposit requirements and payment schedules (including progress payments) are set forth in the written estimate/work order.

Payments are due according to the schedule stated in the written agreement.

Late payments may result in work stoppage and/or late fees to the extent permitted by law.

You are responsible for any bank/processing fees related to returned payments or chargebacks, where permitted.

7) Changes and Additional Work (Change Orders)

Any work outside the written scope (additional rooms, extra prep, repairs, color changes, added coats, etc.) must be approved via a change order (written or documented approval) and may affect price and timeline.

8) Materials, Colors, and Product Selection

Paint products, sheen, and coating systems are selected based on surface conditions and intended durability.

Colors may look different depending on lighting, texture, and surrounding finishes. Customers are responsible for final color approval before full application.

If the customer supplies paint/materials, Meyer Painting is not responsible for product performance, coverage, or color matching.

9) Surface Conditions and Repairs

Many homes have hidden or previously patched areas, water damage, wood rot, failing coatings, or other conditions that are not visible until prep begins. If unexpected conditions are discovered:

we will notify you, and

additional prep/repairs may require a change order.

10) Weather and Force Majeure

Exterior painting is weather-dependent. We are not responsible for delays caused by rain, excessive heat/cold, high winds, smoke, natural disasters, material shortages, or other events beyond our reasonable control.

11) Safety and Jobsite Conditions

For safety, we may pause work if unsafe conditions exist, including (but not limited to): aggressive animals, unsafe electrical issues, hazardous materials, unstable surfaces, or unsafe access. You agree to help maintain a safe working environment.

12) Warranty

Any workmanship warranty, if offered, will be stated in the written estimate/work order and may vary by project type and products used. Warranty coverage typically does not include:

normal wear and tear,

damage from moisture intrusion, leaks, settling, structural movement, or abuse,

failures caused by prior coatings or underlying surface conditions,

customer-supplied materials.

13) Photos and Project Documentation

We may take photos/videos of work areas for documentation, quality control, and internal records. With your permission (or as outlined in your written agreement), we may use non-identifying project photos for marketing (website/social media). If you do not want photos used for

marketing, notify us in writing.

14) Third-Party Links and Tools

This website may reference third-party services (maps, review platforms, scheduling tools). We are not responsible for third-party sites or their privacy practices.

15) Disclaimer of Warranties (Website)

This website is provided “as is” and “as available.” We do not guarantee that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

16) Limitation of Liability

To the maximum extent permitted by law, Meyer Painting shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of this website or communications submitted through it.

If you enter into a separate written agreement for services, liability terms in that agreement may further apply.

17) Indemnification

You agree to indemnify and hold harmless Meyer Painting from claims, damages, liabilities, and expenses arising out of your misuse of the website, violation of these Terms, or violation of any law or third-party rights.

18) Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

19) Severability

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.
